Postscript to my Switzerland update


In my update on Switzerland’s new declarations under the Evidence Convention, I suggested that the new liberalized rules for taking evidence by commissioner applied only to witnesses who were sojourning temporarily in Switzerland, not to residents. “You see, the French version uses séjourner …. “What a dork I am! I now have it on very good authority that the intention was to apply to anyone in Switzerland regardless of residence or nationality. I don’t know why the English was phrased as it’s phrased or why the French was phrased as it’s phrased, but anyway, that is what I am hearing. So read my prior post with that in mind!
