William R. Maguire of Hughes Hubbard & Reed has a new article, Current Issues in Federal Civil E-Discovery, Proportionality, International Discovery and Deposition Practice, and Changes to the Federal Rules of Civil Procedure. Obviously such a broad article cannot comprehensively cover all of the areas within its scope. But the article does provide a good review of the decisions in three relatively recent blocking statute cases: In re Global Power Equip. Group, Inc., 418 B.R. 833 (Bankr. D. Del. 2009), In re Vivendi Universal, S.A. Secs. Litig., 618 F.Supp.2d 335 (S.D.N.Y. 2009), and Schindler Elevator Corp. v. Otis Elevator Corp., 657 F.Supp.2d 525 (D.N.J. 2009). Maguire also discusses the Article 29 Data Protection Working Party’s Working Document 1/2009 On Pre-Trial Discovery For Cross-Border Civil Litigation, a recent consideration of the relationship between the EU Data Protection Directive and US pretrial discovery requests aimed at European firms.
