The decision is only the second time the First Circuit—the federal appellate court here in Boston—has reviewed a decision under § 1782, and the first since Intel, so the case is significant. Case of the Day: Furstenberg Finance v. Litai Assets
The case of the day is Furstenberg Finance SAS v. Litai Assets LLC (11th Cir. 2017). Furstenberg brought an application under § 1782 for leave to serve a subpoena on Litai for use in prospective proceedings in Luxembourg against Dr. Jean-Michael Paul.
