A niche topic I expect, but for those of us like me who are in that niche, it’s an exceptionally interesting one! As it happens I wrote a case comment some years back that addressed (among other issues) which party has the burden to prove sovereign immunity in Canadian law. At the time, the majority view among Canadian courts was the same as the consensus view in the U.S. I haven’t kept up in this area, though, so I don’t know if things have changed since.
