Ted, good post. And I second the previous comment: I heard Prof. O'Connell speak at a conference in 2007 on the right of states to self-defence in response to terrorism under international law. I was astounded at the time that anyone could take her ideas seriously. (It brings to mind the Orwell quote about how one has to belong to the intelligentisia to believe things like that, as no ordinary man could be such a fool.) Also at that conference, speaking on the same topic, was the Israeli international law scholar Yoram Dinstein. He demolished Prof O'Connell's analysis so thoroughly and so convincingly that I almost felt sorry for her.

MEOC has been saying these sorts of things for decades now—it’s a political project for her, and the Iraq debacle means that public international law academia has several outlets that are friendly to this view (notably EJIL Talk and Opinio Juris).
