As Mr. Fölsing points out in his comment, the Court, as expected, denied the motion. I looked up the jurisdictional question in the Shapiro treatise, and here is what it says (at 6-19 and 6-20, with citations omitted):

"[The] jurisdictional requirement of timeliness is strictly applied in civil cases. No exceptions or waivers are recognized; no matter how extenuating the circumstances, an untimely petition will not be entertained.

"The Court is so firm in its holdings that it lacks jurisdiction over a petition in a civil case filed beyond the time limits set by Congress that it has instructed the Clerk to reject such a petition without docketing or circulating it to the Court. ...

"A party's only remedy is to file a motion asking the Court to order the Clerk to accept a petition that he or she has rejected, perhaps on the ground that the Clerk's time calculations were wrong. No such motion has as yet been granted."

Dear Mr. Folkman, again you were right to assume that this would be your last post on the Donziger cert. petition. As the Supreme Court's order list of today shows the petition to direct the clerk to file the cert. petition out of time has been denied. Too bad. All the best from Hamburg, Philipp Foelsing
