I read Justice Sotomayor’s concurrence slightly differently. Her footnote shows she understands exactly what is going on here (she’s super smart and had experience with international arbitration as a practitioner). I think she writes for future cases in which the Republican block will continue to force consumers to arbitrate against their will.
