I read Justice Sotomayor&#039;s concurrence slightly differently. Her footnote shows she understands exactly what is going on here (she&#039;s super smart and had experience with international arbitration as a practitioner). I think she writes for future cases in which the Republican block will continue to force consumers to arbitrate against their will.
