Anon, thank you for the comment and for calling the &lt;em&gt;Telegraph&lt;/em&gt; article to readers&#039; attention. I don&#039;t want to speculate about whose account of the contents of the Price interview tape is correct. The whole point of the best evidence rule, which I referred to in the post, is to require parties to use the best evidence of a document&#039;s contents&#8212;here the tape itself&#8212;to prove the document&#039;s contents. So let the judge hear what the tape says, and avoid these dueling statements. 

I can&#039;t really comment on what is or is not likely to affect a UK proceeding, as I&#039;m not a UK lawyer, but it seems to me that in general, a statement in the newspaper will not, or at least should not, have any effect.]]></description>
